When is an incident considered a workplace accident in the Netherlands?
A workplace accident occurs when you suffer an injury while performing your work. This can happen at the workplace, while working at an external location or during work-related activities. In some cases, commuting accidents may also qualify, depending on the circumstances.
Is my employer liable for a workplace accident?
In most workplace accident cases, the employer is legally liable. Under Dutch law, employers have a duty of care to provide a safe working environment.
An employer can only avoid liability if they can prove that they took all reasonable measures to prevent the accident. In practice, this is difficult, because the employer’s duty of care is extensive and requires proper safety measures and supervision.
An exception may apply if the employee acted intentionally or with deliberate recklessness. In such cases, the employer may not be held liable.
Am I entitled to compensation after a workplace accident?
Yes. If your employer is liable for the workplace accident, you are entitled to full compensation for your damages. This may include medical expenses, loss of income, travel costs, household assistance and compensation for pain and suffering.
What should I do immediately after a workplace accident?
Report the workplace accident to your employer immediately. Seek medical attention and make sure your injuries are properly documented. Is my employer required to report a workplace accident to the Labour Inspectorate?
Yes. In cases involving serious injury, the employer is legally required to report the workplace accident to the Dutch Labour Inspectorate (Nederlandse Arbeidsinspectie). Failure to report may have consequences and can play a role in the assessment of liability.
How is compensation calculated after a workplace accident?
