At AVB Law, we have an experienced mediator in house: Raymond Alberts. He has more than twenty years of experience in the field of personal injury law and understands both the position of injured victims and that of insurance companies. He has followed the mediation training of the Mediatorsfederatie Nederland (MfN).  

Because he understands how both injured parties and insurers assess personal injury files, he can identify misunderstandings and bring discussions back to the core of the dispute. He brings structure and calm to processes that are often emotional or complex and helps parties work towards realistic solutions. He speaks the language of victims, but also that of insurers, which makes him particularly effective as a mediator. 

When mediation can help

In personal injury cases, it sometimes happens that the process reaches a standstill. Positions harden, communication becomes difficult and the process starts to cost more energy than it brings results. Although the parties may wish to move forward, a solution seems increasingly out of reach. In such situations, mediation can offer a way forward. Mediation is not an alternative to the law, but a different way of engaging in dialogue and working towards a solution that is workable for everyone involved.

Who mediation is suitable for

Mediation through AVB Law is intended for situations in which multiple parties are involved in a personal injury dispute and wish to create progress. This may include injured victims, employers, insurers, claims handlers or other professionals.

Mediation is often used when disagreements arise about liability, financial compensation, causation, reintegration into work or the further handling of a file. It can also be helpful when a case is escalating or has been at a standstill for a longer period of time.

How a mediation process works

A mediation process begins with an exploratory phase to assess whether mediation is appropriate. If so, joint agreements are made about the process, including voluntariness and confidentiality.

During the sessions, parties have the opportunity to explain their positions and underlying interests. The mediator guides the discussions, helps clarify points of difficulty and explores possible solutions. If agreement is reached, it is recorded in a settlement agreement.
